Brady Kiser, husband of popular TikTok influencer Emilie Kiser, will not face criminal charges following the tragic drowning of their 3-year-old son, Trigg, in the family’s backyard pool in Chandler, Arizona. The incident occurred while Emilie was out with friends, leaving Brady at home caring for their newborn, Theodore, and Trigg.
According to authorities, Brady told police he had turned away for just a few minutes before discovering Trigg unresponsive in the pool. Emergency crews responded swiftly, performing CPR before the boy was transported for further treatment. Trigg died six days later in the hospital.
On July 15, Chandler Police recommended Brady be charged with felony child abuse, a class 4 offense that could carry a prison sentence ranging from one to 3.75 years, though probation is possible. However, the Maricopa County Attorney’s Office announced it would not pursue charges, citing insufficient evidence for a conviction.
Prosecutors explained that a conviction would require proof beyond a reasonable doubt that Brady failed to recognize a significant and unjustifiable risk in a way that grossly deviated from how a reasonable person would act. After a thorough review involving senior attorneys and the County Attorney, they concluded the case did not meet that standard.
Meanwhile, Emilie Kiser has taken legal action to block the release of records tied to the investigation and autopsy of her son, reflecting the family’s desire for privacy amid public interest in the case.
